Nyílt levél a devecseri szélsőjobboldali demonstráció miatt
A devecseri tüntetést a rendőrségnek fel kellett volna oszlatnia, hiszen az már a beszédek elhangzásakor elvesztette békés jellegét, majd fizikai erőszakba torkollott, amikor a tüntetők betondarabokat dobáltak. Emberi jogi szervezetek nyílt levéllel fordulnak a belügyminiszterhez és a rendőrfőkapitányhoz intézkedéseiket kérve.
Tisztelt Belügyminiszter Úr és Országos Rendőrfőkapitány Úr!
Aláíró jogvédő szervezetek határozott álláspontja szerint a 2012. augusztus 5-én, Devecseren megtartott szélsőjobboldali demonstráció átlépte a törvényesség határát. A helyszíni beszámolók és a helyszínen készült felvételek tanúsága szerint a tüntetés már a beszédek elhangzásakor elveszítette békés jellegét, majd fizikai erőszakba torkollott, amikor a tüntetők a helyi cigányokat, illetve a cigányok lakta házakat kövekkel, betondarabokkal dobálni kezdték. Ezért a tüntetést a rendőrségnek fel kellett volna oszlatnia. Ez nem történt meg, és ezzel a rendőrség súlyos mulasztást követett el, mert nem védte meg honfitársaink szabadsághoz, egyenlőséghez és biztonsághoz való jogát.
Az Alaptörvény és a gyülekezési jogról szóló törvény csak a békés rendezvényeket védi. A törvény szerint a gyülekezést a rendőrségnek fel kell oszlatnia, ha az bűncselekményt vagy bűncselekmény elkövetésére való felhívást valósít meg, vagy az mások jogainak és szabadságainak sérelmével jár. A szóban forgó tüntetésen mindezen oszlatási okok fennálltak, a rendőrség mégsem tett semmit. A feloszlatásra már az is okot adhatott volna, hogy a tüntetők egy része vezényszóra, egyenruhában masírozott, majd a rasszista, cigányellenes jelszavakat skandáló tömeg szándékosan a település köztudottan romák lakta utcáira vonult, és a kiszolgáltatott kisebbségi lakosoknak az őket pusztán etnikai hovatartozásuk miatt megalázó verbális megnyilvánulásokkal kellett szembesülniük („foglyul ejtett közönség”). A gyűlöletbeszéd határait értelmező 95/2008. (VII. 3.) AB határozat, valamint a Magyar Gárda feloszlatását kimondó jogerős bírósági ítélet szerint ugyanis egy tüntetés anélkül is sértheti mások szabadsághoz és biztonsághoz való jogát, hogy erőszakossá válna, amennyiben az összes körülmény mérlegelésével megállapítható, hogy a szélsőséges vélemény célpontját képező csoport kénytelen szembesülni a gyűlölködő közléssel, és az elől nem tud kitérni. A helyszínt biztosító rendőrök azonban még akkor sem kaptak parancsot az események megállítására, amikor a szemük láttára kezdődött el a kődobálás, a tényleges fizikai erőszak. Némaságával a magyar rendőrség Devecseren asszisztált az atrocitáshoz.

Elfogadhatatlannak és jogsértőnek tartjuk, hogy a magyar rendőrség ilyen helyzetben passzív maradjon. A rendőrség feladata a bűncselekmények megelőzése és felderítése. Erre tekintettel az aláírók felszólítják Önöket arra, hogy:
– a békés állampolgárok jogainak és testi épségének védelme terén tanúsított rendőrségi mulasztást haladéktalanul vizsgálják ki, és a vizsgálat eredményéről a nyilvánosságot tájékoztassák;
– gondoskodjanak a büntetőeljárások hivatalból való megindításáról, valamint arról, hogy a rendőrség a rendelkezésére álló saját készítésű és nyilvánosan elérhető filmfelvételek alapján, az elkövetők nyilvánvalóan előítéletes indítékaira tekintettel folytassa le a nyomozást;
– tegyenek hatékony intézkedéseket annak érdekében, hogy a jövőben ilyen törvénytelenségek ne fordulhassanak elő!
Végül javasoljuk, hogy a rendezvények biztosítása, a tüntetések békés jellegének megóvása, valamint a jogsértővé váló tüntetések feloszlatása körében tanúsítandó jogszerű rendőrségi reakció tisztázása érdekében a Belügyminisztérium, az Országos Rendőr-főkapitányság, továbbá a jelen nyílt levelet aláíró civil szervezetek között mielőbb szakmai egyeztetésre kerüljön sor.
