#Ukraine Destitution and homelessness: the situation of vulnerable Ukrainian beneficiaries of temporary protection

Third party intervention at the ECtHR in Trapitsyna and Isaeva v. Hungary, app. no. 5488/22

The Hungarian Helsinki Committee (HHC) submitted a third party intervention to the European Court of Human Rights on 17 February 2023 in Trapitsyna and Isaeva v. Hungary, app. no. 5488/22 that concerns the interference with the right to private and family life of a Russian citizen and her minor daughter by the withdrawal of their residence permits and expulsion on the basis of undisclosed information concerning the risk to national security.

Through this third party intervention, the HHC reflects on:

• Hungarian national context regarding access to classified data in national security cases, including legislation and domestic jurisprudence;
• EU law standards on the access and use of classified information in administrative procedures and on the nature and scope of the judicial review with regard to legality of the lawfulness of the classified data;
• the requirements deriving from the obligation to take the best interest of the child as a primary consideration into account in procedures when an alleged risk or threat to national security is assessed and weighed in an immigration context.
