New developments ignore the letter and spirit of the Baka judgment
The Committee of Ministers of the Council of Europe supervising the implementation of the judgments of the European Court of Human Rights will put the case of former Chief Justice András Baka on the agenda in June 2024 again to examine the steps taken by Hungary to remedy the systemic problems that also concern Hungarian judges’ freedom of expression.
In their last decision, the deputies reiterated their concern about the absence of progress more than seven years after the Baka judgment became final and urged Hungary to provide an analysis of the legislation adopted on judges’ freedom of expression. In advance of the next meeting, the Hungarian Helsinki Committee submitted a communication on the execution of the judgment, pointing out the Hungarian authorities’ failure to take the necessary measures to implement the judgment and several developments that fly in the face of the letter and spirit of the judgment delivered in the Baka case.
