Selected Rule of Law issues and Actionable Recommendations for the Article 7(1) Hearing

Today, there will be a hearing in the framework of the Article 7(1) procedure on Hungary in the General Affairs Council of the European Union. Eighteen months have passed since the last hearing, and during that time, the governing majority has continued to erode the rule of law in Hungary in almost every area the Article 7(1)  procedure covers. In addition, new rule of law and human rights challenges have emerged.

We looked at six critical areas related to the rule of law and human rights, which should be discussed in our view at the hearing:

  • creating a “parallel state”;
  • rule by decree;
  • independence of the judiciary;
  • implementation of CJEU judgments;
  • media freedom;
  • violating the rights of LGBQI people.
