The Hungarian Helsinki Committee’s client, a 23-year-old Iraqi man, entered Hungary irregularly in 2015. He immediately informed the police that he needs asylum in Hungary. He was then placed in asylum detention, even though the authorities issued him a humanitarian permit for the duration of the procedure.
His detention was unlawful, the ECtHR ruled now. Our client had to wait eight years for this confirmation, and we are happy to see him being compensated for this ordeal. We are way less happy to see that the situation has worsened ever since: asylum seekers arriving irregularly are no longer detained, but forced out to Serbia without any due process.
