The Immigration and Asylum Office continues to ignore court decisions and interim measures

The Hungarian Immigration and Asylum Office (IAO) ignored the instructions of domestic courts regarding the placement of applicants in facilities other than the transit zones on several occasions. The IAO also continues its practice of ignoring the interim measures of the European Court of Human Rights concerning the placement of asylum seeking applicants in an environment that meets the requirements of the absolute prohibition of inhuman or degrading treatment enshrined in Article 3 of the European Convention on Human Rights.

The HHC’s information update discusses in detail a total of seven cases from 2018 where the IAO ignored interim measures, resulting in the prolonged detention of the applicants in the transit zones.
