Response to FRANET: human rights violations at the EU’s external borders
The Hungarian Helsinki Committee received a request to provide information to the Hungarian member of the FRANET research network of the EU’s Fundamental Right Agency on investigations of fundamental rights violations and criminal offences at the EU’s external borders.
FRANET questions received:
– Do you know of cases of which the authorities became aware, but did not act upon the matter? If yes, please briefly describe the circumstances.
– In your opinion, are disciplinary and other non-judicial procedures (e.g. procedures of national monitoring bodies) effective? In your experience, have concerns arisen in this area?
– Have you experienced a case in which procedural guarantees were not observed (e.g. inadequate interpretation or legal support), or methodological deficiencies (e.g. failure to interview witnesses) or evidentiary issues occurred, either during preliminary investigations or court proceedings?
