“Expulsion and Human Rights” is a brief guidance document intended primarily for judges on how to apply the prohibition of torture, inhuman and degrading treatment or punishment in expulsion and extradition cases (by Gábor Gyulai).

“Expulsion and Human Rights” is a brief guidance document intended primarily for judges on how to apply the prohibition of torture, inhuman and degrading treatment or punishment in expulsion and extradition cases (by Gábor Gyulai).

The aim of the publication is to present the human rights obligations related to the prohibition of torture, inhuman and degrading treatment or punishment, as well as their extraterritorial application in cases of forced return, in a brief, user-friendly form, indicating the relevant international legal norms and case law.

Although the population of foreigners in Hungary is still low compared to other European states, Hungarian judges have to decide on the “returnability” of foreigners more and more frequently. Meanwhile, hardly any academic or practical guidance is available on the non-refoulement principle in Hungarian language, thus this note aims to fill a considerable gap.

The preparation and the publication of the guidance document were funded by the European Return Fund and the Hungarian Ministry of Justice and Law Enforcement, in the framework of the “Human Rights Aspects of Return” project.
